This Acceptable Use Policy ("AUP") forms an integral part of the Lana Commerce, Inc. Terms of Service ("Agreement") between Lana Commerce, Inc. ("Lana," "We," "Us," "Our") and the Merchant ("You," "Your") governing the use of the Lana Services ("Services").
Violation of this AUP may result in the suspension or termination of Your Account and access to the Services, as outlined in the Agreement. Capitalized terms used but not defined herein shall have the meaning set forth in the Agreement.
You agree not to use, and not to permit any third party (including users associated with Staff Accounts) to use, the Services in ways that violate this AUP.
1. Illegal, Harmful, or Offensive Use or Content
You may not use, or encourage, promote, facilitate, or instruct others to use, the Services for any illegal, harmful, fraudulent, infringing, or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, fraudulent, infringing, or offensive. Prohibited activities or content include:
- Illegal Activities: Any illegal activities, including advertising, transmitting, or otherwise making available gambling sites or services or disseminating, promoting, or facilitating child pornography or exploitation. Promoting or facilitating unlawful activities.
- Harmful or Fraudulent Activities: Activities that may be harmful to others, Our operations or reputation, including offering or disseminating fraudulent goods, services, schemes, or promotions (e.g., make-money-fast schemes, Ponzi and pyramid schemes, phishing, or pharming), or engaging in other deceptive practices.
- Infringing Content: Content that infringes or misappropriates the intellectual property or proprietary rights of others (including patent, trademark, trade secret, copyright, right of publicity, or other rights).
- Offensive Content: Content that is defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable, including content that constitutes child pornography, relates to bestiality, or depicts non-consensual sex acts. Content that is discriminatory or abusive toward any individual or group.
- Harmful Content: Content or other computer technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, time bombs, or cancelbots. Using Our platform for malware or exploit delivery (e.g., as part of a command and control system).
- Terrorism-Related Content: Content that supports, promotes, or funds terrorism or terrorist activities.
- Sensitive or Confidential Information: Disclosing personal or confidential information of others without their explicit consent. Processing or storing sensitive personal data (as defined under applicable data protection laws) without explicit consent and appropriate safeguards.
2. Prohibited Conduct and Activities
In addition to the content restrictions above, You agree not to engage in the following activities while using the Services:
- Abuse and Harassment: Harassing, abusing, threatening, or inciting violence towards any individual or group, including Lana employees, officers, agents, or other Lana Merchants.
- Impersonation: Impersonating any person or entity, including any of Our employees or representatives, including through false association with Lana, or by fraudulently misrepresenting Your identity or Your store's purpose.
- Violation of Privacy: Violating the privacy of any third party, such as by posting another person's personal information without consent.
- Service Resale: Reproducing, duplicating, copying, selling, reselling, or exploiting any portion of the Service, use of the Service, or access to the Service without Lana's express written permission.
3. Security Violations and Network Abuse
You may not use the Services to violate the security or integrity of any network, computer or communications system, software application, or network or computing device (each, a "System"). Prohibited activities include:
- Unauthorized Access: Accessing or using any System without permission, including attempting to probe, scan, or test the vulnerability of a System or to breach any security or authentication measures used by a System.
- Interception: Monitoring of data or traffic on a System without permission.
- Falsification of Origin: Forging TCP-IP packet headers, e-mail headers, or any part of a message describing its origin or route. This prohibition does not include the use of aliases or anonymous remailers.
- Service Disruption: Interfering with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a System, broadcast attacks, or any activity that attempts to disrupt or tamper with Lana servers in ways that could harm Our Website or Service.
4. Email and Communication Abuse
You will not use the Services to distribute, publish, send, or facilitate the sending of unsolicited mass e-mail or other messages, promotions, advertising, or solicitations (like "spam"), including commercial advertising and informational announcements. You will not use Our servers for any form of excessive automated bulk activity or relay any other form of unsolicited advertising or solicitation through Our servers. You will not alter or obscure mail headers or assume a sender’s identity without the sender’s explicit permission.
5. Excessive Use of Shared Resources
You may not use the Services in a way that places undue burden on Lana servers or infrastructure, or consumes a disproportionate share of the network resources, interferes with the normal operation of the Services, or impacts the performance of the Services for other Merchants. This includes, but is not limited to:
- Engaging in activities that cause excessive bandwidth or storage consumption relative to other Merchants.
- Using the platform for resource-intensive activities not related to standard e-commerce operations, such as cryptocurrency mining.
We reserve the right to determine, in Our sole discretion, what constitutes excessive usage and may suspend Your Account or throttle Your Service usage if such usage is deemed excessive.
6. Restricted Businesses
You may not use the Services in connection with any business or activity deemed restricted by Lana. A list of restricted businesses may be published separately by Lana and incorporated herein by reference, or may be included within the main Terms of Service. You agree not to contravene or circumvent this policy.
7. Our Monitoring and Enforcement
We reserve the right, but do not assume the obligation, to investigate any violation of this AUP or misuse of the Services. We may:
- Investigate violations of this AUP or misuse of the Services.
- Remove, disable access to, or modify any content or resource that violates this AUP or any other agreement we have with You for use of the Services.
- Report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties.
- Suspend or terminate Your access to the Services.
8. Reporting of Violations of this AUP
If You become aware of any violation of this AUP, You agree to immediately notify Us and provide Us with assistance, as requested, to stop or remedy the violation. To report any violation of this AUP, please contact hello@lana.dev.
9. Modifications to this AUP
We may modify this AUP at any time by posting a revised version on the Lana website or by notifying you in accordance with the Agreement. By continuing to use the Services after the effective date of any modifications to this AUP, you agree to be bound by the modified version. It is Your responsibility to check the Lana website regularly for modifications to this AUP.
